Purpose Of Job Under general direction, represents the City, its officials, and employees in civil cases. Under general supervision of the City Attorney and Assistant City Attorney: Represents and provides legal advice to the City, City Officials, or employees in all aspects of municipal law. Represents the City in all City Court matters, including the contested case docket. Researches legal issues and prepares legal opinions, memoranda and correspondence. Maintains and develops expertise about laws, regulations, and court decisions affecting municipal legal issues. B. Document Review Drafts and/or assists in preparing ordinances, resolutions, leases, contracts, etc., relating to municipal concerns. Reviews rules, policies, plans, and forms prepared by other City personnel for compliance with applicable laws. Prepares and/or reviews contract documents for construction projects and for the purchase, lease, or sale of goods, services and professional services including specifications, bid documents, requests for proposals, requests for qualifications, and contractual agreements. Prepare demand letters for delinquent accounts, including utilities, hotel-motel tax, and other outstanding City accounts receivable. C. Records Requests Continually monitors changes to Tennessee Public Records Law. Gives advice to assigned department records custodians on open records requests. Reviews records requests for necessary redactions. D. Training Delivers annual training to all department heads, boards, and commissions. III. Other Job Duties Performs other job duties as assigned, including: Attends meetings to give guidance and advice as needed. Answers phone calls and greets visitors as backup. Performs related duties and responsibilities to assist other employees in the department as required. May deliver training and presentations to outside groups and career associations. IV. Primary Job Challenges The Law Department is a fast-paced department. Must be able to change focus quickly. To perform this job successfully, an individual must be able to: Maintain effective working relations with City officials and the public; Research, analyze and apply legal principles; Present logically and clearly statements of law and fact; Organize, interpret, and apply legal principles and knowledge of complex legal problems; effectively apply legal knowledge and principles in court; Present statements of law, fact and argument clearly and logically; Prepare and present difficult cases in court; Communicate effectively, both orally and in writing; Conduct research on complex legal problems and prepare sound legal opinions; Properly interpret and make decisions in accordance with laws, regulations, and policies; and Communicate clearly and concisely, orally and in writing. V. Equipment Operated Computer and other office equipment such as printers and fax machines and personal devices such as iPads, etc. Job Content Knowledge: Has general knowledge of the policies, procedures, and activities of the City and its administrative practices as they pertain to the performance of duties relating to the position of Staff Attorney. Has general knowledge of Legal Division as necessary in the completion of daily responsibilities. Has general knowledge of City codes, ordinances, and policies. Knows how to develop and administer operations and staff plans and objectives for the expedience and effectiveness of specific duties of the department. Has comprehensive knowledge of the terminology, principles, and methods utilized for City operations. Is knowledgeable and proficient with computers. Has familiarity with general principles of tort, contract, municipal government employment law and state and local court rules and procedures. Has familiarity with customs and procedures of the General Sessions Court, Circuit Court and Chancery Court. Is familiar with general rules of discovery. Has thorough understanding of confidentiality and maintaining client confidence in accordance with the Tennessee Rules of Professional Conduct. Language Skills : Ability to read, analyze, and interpret the most complex documents. Ability to respond effectively to the most sensitive inquiries or complaints. Ability to write speeches and articles using original or innovative techniques or style. Ability to make effective and persuasive speeches and presentations on controversial or complex topics to top management, public groups, and/or boards of directors. Mathematical Skills: Ability to add, subtract, multiply, and divide in all units of measure, using whole numbers, common fractions, and decimals. Ability to compute rate, ratio, and percent and to draw and interpret bar graphs. Reasoning Ability: Ability to define complex problems, collect data, establish facts, and draw valid conclusions. Ability to interpret an extensive variety of technical instructions in mathematical or diagram form and deal with several abstract and concrete variables. Teamwork: Develops constructive and cooperative working relationships with others. Encourages others to express their ideas and opinions. Provides input into identifying and solving problems. Anticipates need of others for information about job tasks and work environment and provides it to them in a timely manner. Willingly assists others with job tasks when appropriate. VII. Physical Demands and Work Environment Physical Demands: Performance of the essential duties of this job requires the incumbent to: Must be able to remain in a stationary position 75% of the time. Occasionally move about inside the office/building to access file cabinets, office machinery, the public, etc. Constantly operates a computer and other office productivity machinery, such as a calculator, copy machine, computer, printer, and telephone. Regularly positions self to maintain office area and items needed to complete daily tasks. Regularly communicates information and ideas so others will understand. Must be able to exchange accurate information in these situations. Occasionally moves/transports up to 10 pounds. Performance of the essential duties of this job requires: The work environment is moderately noisy (examples: business office with computers and printers, light traffic). VIII. Qualifications Education and Experience: The required knowledge, skill, and abilities to satisfactorily perform job duties are normally acquired through obtaining a Law Degree (J.D.) and 1-5 years’ experience in the practice of law.
